TERMS AND CONDITIONS

1. APPLICATION

 

1.1 Parties. These Terms and Conditions govern your purchase of Services. You are the "Customer" or "you".

Ari R. E. Lurtz, a self-employed professional operating under the brand name "Ari & Alisa", is the "Provider", "we", "us", or “our". These Terms and Conditions establish the contractual relationship between you and us for all Services purchased.

 

1.2 Provider Details. Website owner and operator: Ari R. E. Lurtz.

1.3 Customer Eligibility. These are the terms on which we sell all Services to you. You may only purchase Services if you are at least 18 years old, have full legal capacity to enter binding contracts, and reside in a jurisdiction where such purchases are lawful.

 

1.4 Modifications. We reserve the right to update or modify the Terms and Conditions from time to time. The version of the Terms and Conditions published on the Website at the date and time you book the Service will apply to that booking.

 

1.5 Acceptance. By placing an Order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. A checkbox confirming acceptance is required during the booking process.

 

1.6 Service Availability.

Locations. Services are generally delivered remotely online worldwide. Some Services are also offered in-person in the Canary Islands, Spain. Additional locations may be arranged based on our availability; external invitations are considered only when compatible with our schedule.

Languages. All Services and materials are delivered in English, Spanish, or German. Other languages are currently unavailable.

Time Zones. Services are scheduled in Atlantic/Canary time (WET/WEST or UTC±0/UTC+1). You are responsible for confirming your local time conversion.

2. INTERPRETATION

 

2.1 Contract. The Contract means the legally-binding agreement formed between Customer and Provider upon acceptance of the Order. The Contract comprises these Terms and Conditions, the Order confirmation, and any additional service descriptions provided at the time of purchase.

2.2 Services. Services means those offered by the Provider and described on the Website at the time of booking, currently including: 

(a) ThetaHealing® Seminars (online and/or in-person); 

(b) 1:1 Life Coaching Sessions and Life Coaching Programs (online and/or in-person); 

(c) Workshops and Retreats (online and/or in-person);

Services may be delivered via online, in-person, or hybrid modalities. Specific Service terms may vary by offering type.

2.3 Order. An Order means the Customer's request to purchase Services submitted via the Website booking process, including payment and receipt of an Order confirmation email. The Order becomes binding upon Provider's acceptance.

2.4 Website. The Website means www.arialisa.com, including any associated subdomains, mobile applications, or digital platforms operated by the Provider for advertising and selling Services.

 

2.5 Force Majeure. Force Majeure means any event beyond the reasonable control of the affected Party, which could not have been foreseen at the time of Contract formation, and whose consequences could not have been avoided despite all reasonable efforts. Examples include but are not limited to: acts of God, natural disasters, war, terrorism, civil unrest, pandemic or epidemic outbreaks, government actions, or strikes or labour disputes (excluding those involving Provider's employees), power failures, internet outages, or other infrastructure failures. Force Majeure does not include events resulting from the affected Party's negligence, breach, or failure to maintain reasonable business continuity measures.

 

3. INTELLECTUAL PROPERTY

 

3.1 Ownership. All content on the Website including but not limited to text, graphics, logos, images, video and audio clips, downloads, data compilations, software, and the overall selection and arrangement thereof is either the exclusive property of Ari R. E. Lurtz or used under appropriate license, and is protected by Spanish and international copyright, trademark, and intellectual property laws.

 

3.2 Trademarks. "ThetaHealing®" and "ThetaHealer®" are registered trademarks of the ThetaHealing Institute of Knowledge (THINK or Lets THInK Unique). The use of these trademarks is limited to the certification seminars provided by official and authorized ThetaHealers and ThetaHealing Instructors, in accordance with THINK's brand guidelines. All other trademarks appearing on the Website are the property of their respective owners.

 

3.3 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes only, unless expressly authorized in writing.

 

3.4 Restrictions. You shall not, except where permitted by applicable law: 

(a) reproduce, distribute, or modify any content; 

(b) create derivative works from any content; 

(c) reverse engineer any software on the Website; 

(d) remove any copyright or proprietary notices; 

(e) use content for commercial purposes without prior written consent; 

(f) scrape, crawl, spider, or extract data using automated means without prior written consent; 

(g) circumvent any security measures, access controls, or technical limitations on the Website; or

(h) violate any applicable law or regulation.

 

4. USE OF THE WEBSITE AND MEETING ROOM (VIRTUAL/IN-PERSON)

 

4.1 Domain Ownership. The domain name www.arialisa.com, and any subdomains or related domains providing access to this Website, are the exclusive property of Ari R. E. Lurtz, operating under the brand name "Ari & Alisa".

 

4.2 Customer Responsibility. You are solely responsible for your use of the Website and any content you submit. We maintain reasonable security measures but do not guarantee uninterrupted or error-free operation.

 

4.3 Prohibited Conduct on Website. You agree not to engage in conduct that harms the Website, us, other users, or third parties. Prohibited conduct includes but is not limited to: harassment, spam, illegal content posting, impersonation, malicious attacks, unauthorized data extraction, or activities violating these Terms. Violations may result in temporary or permanent suspension of access without prior notice.

 

4.4 Prohibited Conduct in Meeting Room. Whether accessed via virtual platforms like Zoom or at an in-person venues for Seminars, Workshops, Retreats, or 1:1 Coaching Sessions, you agree to the following standards:

(a) no harassment, bullying, or intimidation; 

(b) no hate speech based on race, religion, gender, sexuality, disability, or nationality; 

(c) no personal attacks targeting individuals; 

(d) no disruptive behaviour interfering with Seminars, Workshops or Retreats; 

(e) no recording, screenshotting, or sharing of Private Sessions. 

Violations may result in temporary or permanent suspension without refund. Suspension decisions are final at our discretion.

 

4.5 Recording Prohibition. Audio or video recording of Services (ThetaHealing Seminar, 1:1 Coaching Session, Life Coaching Program, Workshop, or Retreat) is strictly prohibited, whether conducted online or in-person. This includes phone recordings, screen capture, transcription, or any other form of documentation. Violation may result in immediate termination of participation and forfeiture of fees without refund. Exceptions may be granted only with prior written consent from the Provider and may be subject to additional fees.

 

4.6 In-Person Responsibilities. For in-person Services, you are solely responsible for your travel, accommodation, venue risks, insurance, and all personal arrangements. We shall not be liable for disruptions, losses, or injuries arising from factors outside our direct control, including travel delays, venue conditions, or third-party services. Where we cancel or reschedule Services, see Section 9.2(c).

5. SERVICES

 

5.1 Service Description. The Services are described on the Website. The specific Service purchased is detailed in your Order Confirmation email.

 

5.2 Service Changes. We may make necessary changes to Services. For material changes to Services you have already ordered, we will notify you by email at least 14 days before the change takes effect. You may terminate the Service without penalty if you do not accept the revised Service description.

 

5.3 Booking Details and Book Delivery. You are responsible for providing complete and accurate information during the booking process, particularly for ThetaHealing Seminars. If your seminar includes a ThetaHealing book (where applicable), the book will be shipped via Amazon to the postal address you provided, subject to Amazon's availability in your country. If the address is incorrect or incomplete, we are not liable for lost or undelivered books, and replacement books are not guaranteed. Shipping delays caused by Amazon or customs are outside our control; however, we will coordinate with Amazon to resolve delivery issues where possible. Digital alternatives may be provided where physical delivery is unavailable.

6. PREREQUISITES FOR THETAHEALING® CERTIFICATION

 

6.1 Seminar Prerequisites. With the exception of the ThetaHealing® Basic DNA Seminar, which has no prerequisites, the ThetaHealing Seminar prerequisites set out on the Website at the time of booking apply. You must meet all prerequisites to be eligible to attend. Failure to meet prerequisites may result in denied attendance without refund.

 

6.2 THINK Waiver. To attend the ThetaHealing Seminar and receive certification, you must complete the waiver from ThetaHealing Institute of Knowledge® (THINK®) at least one hour before the event start time (in seminar time zone). This requirement applies to both online and in-person seminars. The waiver link and registration instructions will be sent in your confirmation email (upon booking). A reminder email will be sent according to the following schedule:

(a) Online seminars: one hour before the event start time; 

(b) In-person seminars: one day before the event start time.

Without valid THINK registration, you will not be permitted to attend the seminar. Where THINK's registration system experiences technical failures beyond our control, we will exercise reasonable discretion to accommodate late waivers where feasible.

6.3 Online Participation. For online seminars, you confirm that you will attend via Zoom. You acknowledge that you must have reliable internet connectivity, a functioning camera, and audio equipment to participate fully. You will be required to use Zoom breakout rooms for interactive exercises. You agree to be present and participate for the full duration of each seminar day. Technical difficulties on your end (including internet connectivity issues) do not entitle you to rescheduling or refund.

 

6.4 Attendance and Certification. Certification requires 100% attendance for both online and in-person seminars. Partial attendance does not qualify for certificate issuance.

7. PRIVACY AND PERSONAL DATA

 

7.1 Separate Privacy Policy. These Terms and Conditions should be read alongside, and are in addition to, our Privacy Policy and Cookie Policy, which contain comprehensive information about how we collect, use, retain, and protect your personal data, and about your rights under the General Data Protection Regulation (EU 2016/679). If you reside in the EU, this section applies to you; if you do not, equivalent protections under applicable local laws (e.g., UK GDPR, Swiss FADP, CCPA) apply where required.

 

7.2 Marketing Communications. With your explicit consent, we may send you promotional emails or messages. This consent is separate from service communications (order confirmations, appointment reminders, etc.). You may withdraw consent at any time by contacting info@arialisa.com or using the unsubscribe link in our communications.

 

7.3 Privacy Inquiries. For privacy questions or data subject requests, contact us at info@arialisa.com.

8. PAYMENT AND FEES

 

8.1 Currency. All Fees are stated in Euro (EUR €).

 

8.2 Fee Display. The Fees for the Services are displayed on the Website at the time of booking.

 

8.3 VAT. The Fees include VAT where applicable at the rate in effect at the time of the Order.

 

8.4 Payment Processing Fees. A payment processing fee applies only to event bookings (ThetaHealing Seminars, Workshops, or Retreats) made through Wix Payments (Credit/Debit Card, Apple Pay, Google Pay). Payments are secured via Wix Payments (PCI-DSS compliant). This fee is visible to you at checkout before payment is completed and is non-refundable.

No additional payment processing fees apply for 1:1 Coaching Sessions or Life Coaching Programs bookings.

 

8.5 Fee Changes. We may update Fees from time to time. The Fees displayed on the Website at the time of booking apply to that booking. For existing Service orders, fees cannot be increased after payment confirmation.

 

8.6 Payment Timing. Payment requirements differ by Service type:

(a) For Direct Bookings of ThetaHealing Seminars, Workshops, or Retreats (online or in-person) and 1:1 Coaching Sessions (online only): Payment is required immediately upon placing the Order. We will process payment via Wix Payments (Credit or Debit Card, Apple Pay, Google Pay) or PayPal.

(b) Coaching Programs and 1:1 Coaching Sessions (in-person): Upon time slot approval, you will receive a payment link. Payment must be completed no later than 48 hours before the scheduled Session or Program start.

9. CANCELLATION POLICY, REFUND AND RIGHT OF WITHDRAWAL

9.1 For Online Services. For Online Services (including ThetaHealing Seminars, 1:1 Life Coaching Sessions, Life Coaching Programs, Workshops, or Retreats), if you cancel your participation for any reason, the cancellation policy below will apply:

(a) Free Cancellation. If you cancel up to 48 hours before the start of the Online Service, a full refund will be issued. Cancellation must be made in writing at info@arialisa.com. The refund applies only to the Service Fee. Payment processing fees charged by Wix Payments for event bookings (ThetaHealing Seminars, Workshops, or Retreats) are non-refundable.

(b) Late Cancellation. It is not possible to cancel within 48 hours before the start of the Online Service; no credit or refund is available for cancellation requests after this time.

(c) Bookings and Tickets. Bookings and tickets are non-transferable, and as such it is not possible to sell, give or otherwise transfer your booking or ticket to another person.

(d) Provider Cancellation Rights. We reserve the right to cancel, delay, or move any Online Service for any reason. Depending on each circumstance, we may issue refunds or offer credits for future Online Services as appropriate. In the event of a cancellation or delay of any Online Service held by us, we are not responsible for any lost wages, accommodation costs, travel costs, cancellation fees, or any other expenses you incur in order to attend our Online Service.

(e) Force Majeure and Medical Emergencies. Exceptions apply for Force Majeure events as defined in Section 2.5 or documented medical emergencies as defined in Section 9.7.

 

9.2 For In-Person Services. For In-Person Services (including ThetaHealing Seminars, 1:1 Life Coaching Sessions, Life Coaching Programs, Workshops, or Retreats), if you cancel your participation for any reason, the cancellation policy below will apply:

(a) Service Refund. The days below are calendar days not including the day on which the Service starts.

- If you cancel up to 31 days before the event, you will receive a 75% refund.

- If you cancel 30 days to 15 days before the event, you will receive a 25% refund.

- If you cancel 14 days to the day of the event, you will not receive any refund.

(b) Refund Application. Refund percentage applies only to the Service Fee. Payment processing fees charged by Wix Payments for event bookings (ThetaHealing Seminars, Workshops, or Retreats) are non-refundable.

(c) Bookings and Tickets. Bookings and tickets are non-transferable, and as such it is not possible to sell, give or otherwise transfer your booking or ticket to another person.

(d) Provider Cancellation Rights. We reserve the right to cancel, delay, or move any In-Person Service for any reason. In the event of a cancellation or delay of any event held by us, we are not responsible for any lost wages, accommodation costs, travel costs, cancellation fees, or any other expenses you incur in order to attend our In-Person Service.

(e) Force Majeure and Medical Emergencies. Exceptions apply for Force Majeure events as defined in Section 2.5 or documented medical emergencies as defined in Section 9.7. 

 

9.3 After Service Start. No credit or refund is available if you cancel after the Service (online or in-person) has commenced, if you do not attend (no-show), if you leave early for any reason, or based on subjective dissatisfaction with the presentation, content, or outcome. For purposes of this Section:

(a) Service commencement is determined by the scheduled start time, whether or not you attend;

(b) No refund applies without documented Service failures verified by us;

(c) Each dissatisfaction claim will be evaluated individually; and

(d) Disputes must be filed within 7 days of service completion.

 

9.4 Life Coaching Program. The Life Coaching Program consists of 12 weekly sessions over 3 months. Once the Program has commenced, all scheduled sessions and time slots are binding and cannot be cancelled, rescheduled, or postponed. Rescheduling is permitted ONLY in cases of Force Majeure (Section 2.5), documented medical emergencies (Section 9.7), or disruptions caused by us. All other missed sessions are forfeited without credit or refund.

 

9.5 Conduct, Prerequisites, and Violations. No credit or refund will be issued if you are removed from, terminated from, or denied attendance at any Service due to:

(a) Conduct or recording violations under Sections 4.4 or 4.5;

(b) Failing to meet prerequisites under Section 6.1; or

(c) Any other non-compliance with these Terms.

 

9.6 Right of Withdrawal and Exemptions. The statutory 14-day right of withdrawal under Directive 2011/83/EU applies only to Customers residing in the EU/EEA. For Customers outside the EU/EEA, this right is not applicable unless required by local law. In all cases, the cancellation terms in Section 9.1 to 9.5 govern regardless of jurisdiction. See Section 9.7 for detailed exemptions.

 

9.7 Medical Emergency Definition. For purposes of Sections 9.1(d), 9.2(d), and 9.4, documented medical emergency means written certification from a licensed physician stating inability to attend due to acute health conditions. We reserve the right to validate documentation.

 

10. LIABILITY DISCLAIMER

 

10.1 Medical Advice Disclaimer. Do not rely on the information on the Website as medical advice or as an alternative to medical advice. If you have a specific question on a medical matter, consult your doctor or other qualified healthcare professional. We shall not be liable for any consequences arising from your reliance on Website content as medical guidance.

 

10.2 Treatment Continuation. You should not disregard professional medical advice or discontinue or change medical, psychological, or psychiatric treatment based on content from the Website. We shall not be liable for any harm resulting from changes to treatment plans made without professional supervision.

 

10.3 Service Scope. Our Services are not a replacement for any therapy, medical treatment, or diagnosis. Any change or discontinuation of therapeutic, psychological, psychiatric, or medical treatment should be undertaken under the supervision and guidance of a qualified medical or mental health clinician. We make no promises that our Services provide health benefits, and we shall not be liable for health-related outcomes dependent on your personal circumstances.

 

10.4 Results Disclaimer. Service outcomes vary by individual. We make no guarantees of specific results, improvements, or transformations. Past success stories do not guarantee similar outcomes for you. We shall not be liable for unmet expectations or perceived lack of progress.

 

10.5 Emergency Situations. If you are experiencing a mental health crisis, contact emergency services immediately or reach out to a crisis hotline in your country. We shall not be liable from damages arising from failure to seek appropriate emergency assistance.

 

10.6 General Liability Limitation. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of Services. This includes but is not limited to bodily injury, emotional distress, loss of income, or property damage, except where required by mandatory local law.

11. LIABILITY FOR ONLINE CONNECTIONS

 

11.1 Provider Security Measures. We implement reasonable security measures for systems, software, and infrastructure under our control, in accordance with applicable data protection laws including GDPR Article 32 technical and organizational requirements.

 

11.2 Customer Security Responsibilities. You agree to maintain security for systems, programs, and data within your control. You must keep login credentials and access information confidential and not share them with third parties.

 

11.3 Third-Party Platforms. We shall not be liable for defects, outages, or service interruptions caused by third-party platforms (e.g., Wix, Zoom, PayPal) outside our direct control. This does not exclude liability where we failed to exercise reasonable diligence in selecting or managing third-party partners.

 

11.4 Connection Failure Exclusions. We shall not be liable for interruptions caused by:

(a) Force Majeure events as defined in Section 2.5;

(b) Your equipment, internet connectivity, or technical setup failures;

(c) Violation of Section 4.3 conduct rules leading to service suspension.

 

12. GOVERNING LAW AND JURISDICTION

12.1 Governing Law. This Contract is governed by Spanish law, except where mandatory consumer protection laws of the Customer's country of residence apply.

 

12.2 Consumer Jurisdiction. For Customers residing in the European Union, nothing in this clause affects your statutory right to bring proceedings in the courts of your country of residence. Statutory rights to access the EU Online Dispute Resolution platform at https://ec.europa.eu/odr are preserved.

 

12.3 Business Jurisdiction. For non-consumer (business) Customers, the parties submit to the exclusive jurisdiction of the courts of Las Palmas de Gran Canaria, Spain.
